PART XXVI MISCELLANEOUS

Exemptions

26.1 The Minister may, for such period and on such conditions as may be determined by him or her, exempt on such conditions, if any, as may be determined by him or her, any mine or group or class of mines or any part of a mine or any category of persons by notice in the Gazette or, in the case of a particular mine or person, by notice in writing to such mine or person, from any one or more of the provisions of these regulations.


General safety


26.2 No person shall negligently or wilfully do anything likely to endanger life or limb in the mine, or negligently or wilfully omit to do anything necessary for the safety of persons employed or otherwise present in the mine.


Mine manager's schemes


26.3 (1) Any scheme formulated by a mine manager after consultation with the work place safety committee or in the absence of such committee the work place safety representatives for the mine in terms of any paragraph of these regulations shall be -

(a) explained to any person affected by the provisions of the scheme; and

(b) copies of such schemes shall be readily available to any affected person.

(2) (a) The Chief Inspector may at any time request in writing any or all mine managers to submit any scheme required to be formulated in terms of these regulations to him or her for inspection, and any such mine manager or mine managers shall forthwith comply with such request.

(b) If the Chief Inspector is of the opinion that a scheme formulated by a mine manager in terms of these regulations is deficient in any respect, he or she may require the mine manager to make such modifications to the scheme as he or she may specify.

(c) The modifications made to the scheme under paragraph (b) shall be explained to any person required to comply with the modified provisions and copies of such amendments shall be made available to any affected persons.


Maintenance and production of registers and records

26.4 All reports, registers and other records required to be kept under the regulations unless otherwise provided for, shall be :-

(a) - kept at the office of the mine or at such other place as the inspector may permit;

(b) - legibly entered in ink in English;

(c) - preserved in the original for a period of not less than 12 months after the date of last entry or report; and

(d) - produced on demand before the inspector.


Repeal and saving



26.5 (1) The provisions of Parts II, III, IV, V and VI of the regulations made under Section 95 of the Mines, Works and Minerals Ordinance 1968 (Ordinance 20 of 1968) of South West Africa, by Government Notice No. 143 of 1968 in Official Gazette No. 2927 of 1 October 1968, and all amendments thereof, are hereby repealed.

(2) Anything done or orders issued under any of the provisions repealed by sub-regulation (1) shall, in so far as they are not inconsistent with these regulations, be deemed to have been done or issued under the corresponding provisions of these regulations.


Short title and commencement


26.6 These regulations shall be called the Mine Health and Safety Regulations, 1999, and shall come into operation on a date to be fixed by the Minister by notice in the Gazette.
